General conditions of sale
I. Definitions
• “GTC”: means these general terms and conditions of sale detailing the conditions of use of the Site and the terms and conditions for placing Orders.
• “Customer”: means any natural or legal person with or without a valid Account and/or placing one or more Orders.
• “Order(s)”: designates the Customer’s firm order(s) for the acquisition of one or more Product(s) available on the Site.
• “Account”: means a valid account of a User allowing the placing of Orders.
• “Content”: means the content (texts, sounds, videos) posted online on the Site by STATEMENT and belonging to it.
• “Personal Data”: means any information relating to an identified or identifiable natural person, directly or indirectly.
• “Privacy Policy”: document established by STATEMENT specifying the processing of Users’ Personal Data and defining their rights.
• “Product(s)”: means the jewelry items offered for sale by STATEMENT via the Site. All Products offered are new.
• “Site”: means the STATEMENT online store accessible at the address www.statement.paris.
• “User”: means any person, customer or not, who visits or consults the Site.
II. Presentation of the site
The Site is published by the company STATEMENT, SAS with capital of €20,000, registered with the Paris Trade and Companies Register under number 833 524 689, whose registered office is located at 21, rue de Marignan – 75008 Paris (France), represented by its President AH CONSULTING, itself represented by its Manager Mrs. Amélie HUYNH.
The General Terms and Conditions are accepted by Customers when placing an Order. They can be viewed at any time on the Website.
III. Placing Orders
3.1. Creation or not of an Account. The User can place an Order by creating an Account or as a guest. A registration confirmation email is sent if an Account is created. The password is strictly personal and confidential. STATEMENT recommends complex passwords and changing them regularly.
3.2. Product Selection. The Customer selects the Products and adds them to the shopping cart. The price including VAT and applicable taxes are indicated. Additional information is available in the “Deliveries and Returns” section.
3.3. Before validation, the Customer verifies the billing and delivery information and accepts the General Terms and Conditions. Payment can be made by credit card or via Stripe. In the case of payment in installments, Alma's terms and conditions apply.
3.4. Confirmation of the Order. A summary is available in the Customer Account and sent by email.
3.5. Delivery. The Products are delivered to the address provided or to the STATEMENT showroom. Tracking is available via the Account.
IV. Conditions of purchase & guarantees
The Customer must be of legal age or, if a minor, have the consent of their legal representatives. Any Order placed in violation of these conditions will be void. STATEMENT reserves the right to refuse or cancel an Order in the event of fraud or violation of the T&Cs.
V. Product Information and Availability
The Products presented on the Site are those available for sale. In the event of unavailability, the Customer will be informed and may modify or cancel their Order.
VI. Prices & delivery costs
Prices are expressed in euros, including VAT. Delivery costs are specified on the Site before the Order is confirmed. Prices are subject to change at any time, except for Orders already confirmed.
VII. Payment & Billing
Payment is made by credit card via a secure service provider. In the event of an incident, STATEMENT will suspend the Order. The invoice is included in the package.
VIII. Shipping & Delivery
Delivery times vary depending on the type of delivery and geographic area.
STATEMENT declines all responsibility in the event of delay caused by a third party, the Client or a case of force majeure.
IX. Right of withdrawal
Non-professional customers have 14 days to exercise their right of withdrawal. The form must be returned to the address indicated. Products must be returned in perfect condition and in their original packaging. STATEMENT will cover the return shipping costs to France/EU.
For purchases made in the STATEMENT boutique, only exchanges or credit notes are accepted, within 14 days of purchase and upon presentation of the receipt.
X. Legal guarantees
The Products benefit from legal guarantees of conformity and against hidden defects. The Customer has 2 years to take action. In the event of a return, the costs are covered by STATEMENT.
XI. Responsibilities
STATEMENT is not responsible for technical interruptions, delays due to external events or fault of the Customer. Its liability may not exceed the amount of the Order.

XIII. Intellectual Property
The Site is the exclusive property of STATEMENT. Any reproduction is strictly prohibited.
XIV. Deletion of the Account
The Customer may request the deletion of their Account by email. This will be effective within two months, except for an Order in progress.
XV. Force Majeure
Neither party may be held liable in the event of force majeure (natural disasters, war, etc.).
XVI. Final Provisions
The General Terms and Conditions are governed by French law. In the event of a dispute, the courts within the jurisdiction of the Paris Court of Appeal shall have sole jurisdiction.
The T&Cs, the Privacy Policy and the terms of the Order constitute the entire agreement between Users and STATEMENT.
STATEMENT's failure to enforce any of the provisions of the T&Cs cannot be considered or interpreted as a waiver.
If one or more provisions of the General Terms and Conditions are declared invalid, the others shall retain their full force and effect. In this case, the parties shall, if possible, replace this invalidated provision with a valid provision corresponding to the spirit and purpose of the General Terms and Conditions.
The T&Cs are governed by French law. The French version of the T&Cs prevails over any other version.
In the event of a dispute, the non-professional Client has the option of resorting to mediation or any other alternative dispute resolution method.
WITHIN THE LIMITS PROVIDED BY APPLICABLE LAW, ANY DISPUTE RELATING TO THE VALIDITY, INTERPRETATION OR EXECUTION OF THE GTC WILL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS WITHIN THE JURISDICTION OF THE PARIS COURT OF APPEAL, INCLUDING IN THE EVENT OF AN APPEAL ON THIRD PARTY OR MULTIPLE DEFENDANTS.
